1. About Us
These Terms of Service govern your use of www.eterna-andenken.de (the "Site") and any purchase you make from us. The Site is operated by:

2. Products
ETERNA Andenken offers personalized memorial and keepsake products (jewelry, home décor, prints, and similar items), made to order based on the personalization details (name, photo, date, or message) you provide at checkout. Product images are representative; the finished personalized item will reflect the exact details you submit.

3. Orders and Payment
- All prices are shown in EUR. Prices do not include separately stated VAT, as ETERNA Andenken operates under the small business exemption (§19 UStG).
- We accept payment via the methods shown at checkout. Your order is confirmed once payment is successfully processed.
- We reserve the right to refuse or cancel an order (e.g., suspected fraud, pricing errors, inability to fulfill), in which case you'll be refunded in full.
4. Shipping
See our Shipping Policy for delivery timeframes and costs. Personalized items require production time before shipping.
5. Your Right to Cancel (Widerrufsrecht)
Under EU consumer law, you generally have a 14-day right to withdraw from a purchase without giving a reason. However, this right does not apply to goods made to your specifications or clearly personalized (Section 312g(2) No. 1 BGB) – which covers most ETERNA Andenken products, since they're custom-made with your chosen name, photo, or message.
For any non-personalized items we sell, the standard 14-day withdrawal right applies from the date you (or someone you designate) receives the goods. To exercise this right, inform us (ETERNA Andenken, partner@eterna-andenken.de) of your decision by a clear statement (e.g. email or letter) before the 14-day period expires.
If you withdraw, we will reimburse all payments received from you, including standard delivery costs, without undue delay and within 14 days of receiving notice of your withdrawal. We may withhold reimbursement until we receive the goods back. You must return the goods without undue delay and within 14 days of informing us of your withdrawal. You will bear the direct cost of returning the goods.
6. Returns, Refunds, and Faulty Items
See our Return and Refund Policy. In short: personalized items are final sale except where damaged or defective on arrival. Your statutory warranty rights (Gewährleistung) for defective goods are not affected by this policy and remain in place for 2 years as required under German law.
7. Intellectual Property
All content on the Site (design, text, graphics, logos) is owned by or licensed to ETERNA Andenken. You may not reproduce or reuse it without permission. Personalization content you submit (names, photos, messages) remains yours; you confirm you have the right to use any photo or text you upload.
8. Liability
We are liable for damages arising from injury to life, body, or health, and for damages caused by intent or gross negligence, without limitation. For ordinary negligence, our liability is limited to foreseeable, contract-typical damages, except where mandatory law (e.g. product liability) provides otherwise.
9. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), accessible at https://ec.europa.eu/consumers/odr. We are not obligated and not currently willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
10. Governing Law
These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This does not deprive you of protections under the mandatory consumer-protection laws of your country of residence if you are an EU consumer.
